The City of Lafayette Police Department Fallen Heroes Fund

About Community Foundation of Acadiana. Community Foundation of Acadiana (www.cfacadiana.org) is a 501(c)3 tax-exempt foundation whose core purpose is to build legacies and improve communities by connecting generous people to the causes they care about.

About the Fund. In July 2017, per the vision of the City of Lafayette Police Chief Toby Aguillard, Community Foundation of Acadiana (CFA) established The City of Lafayette Police Department Fallen Heroes Fund.

Purpose of the Fund. The purpose of the Fund is to provide some financial relief to any City of Lafayette Police Department officer or employee, or any family of any City of Lafayette Police Department officer or employee, killed or wounded in the line of duty.

Acadiana supports its law enforcement officers. As usual, our Lafayette and Acadiana community now rises to the occasion to benefit the family of Cpl. Michael Middlebrook, a brave American hero, OUR hero. The City of Lafayette Police Department Fallen Heroes Fund can receive tax-deductible contributions in any amount from any source for this purpose. This Fund will illustrate our communities’ support of Cpl. Middlebrook and honor his ultimate contribution to our community.

CFA’s trusted oversight. Since inception in 2000, CFA has been entrusted with almost $200 million in generous charitable and philanthropic resources. In the case of The City of Lafayette Police Department Fallen Heroes Fund, CFA and its Advisory Committee have trustworthy discretion over grant disbursements and gifts from this Fund. This discretion is guided by IRS rules and regulations and donor intent.

Grant disbursements and gifts from the Fund. Obviously, the actual benefits from this Fund depends on the actual tax-deductible contributions to the Fund. CFA expects to communicate and coordinate with Cpl. Middlebrook’s widow to determine optimal benefit to the Middlebrook family. This Type of Fund will avoid paying for anything that would otherwise be paid for by insurances. Per communication and coordination with the Middlebrook family, some gifts may be made directly to the family while other grant disbursements may be paid directly to third- parties to pay expenses on behalf of the Middlebrook family (e.g. funeral expenses; educational expenses; etc.). In all cases, as noted below, whether direct or indirect payments, 100% of all generous tax-deductible contributions to this Fund will benefit Cpl. Middlebrook’s family.

Fees. Thanks to CFA’s generous Members / Partners, CFA does not assess a Fee for this Fund.

Tax liability. CFA does not provide tax advice or guidance and encourages all donors and recipients to seek professional guidance. Having said that, generally, "charitable assistance,” in this case to benefit the Middlebrook family, is considered a ‘gift’ and is not taxable.
